行政复议决定公开内容的检视与完善

摘　　要：新《行政复议法》第三条、第七十九条确立了行政复议决定公开制度。行政复议决定公开制度是新时代法治政府建设的必然要求,关系到社会公众知情权、监督权的实现。新《行政复议法》以及行政复议相关的法规并未就行政复议公开内容的范围进行详细规定,基于各地实践探索情况,行政复议决定公开内容目前主要存在公开内容款项、公开详细程度以及公开中对于个人信息保护程度等问题,同时,行政复议中规范性文件审查结果和行政委员会的咨询意见,是否应纳入行政复议决定公开的范畴,亦是推进行政复议决定公开亟须解决的问题。为了更充分地发挥行政复议决定公开制度的功效,有必要规范行政复议决定公开的内容,并将行政复议规范性文件审查的结果和行政复议委员会的咨询意见一并公开,以完善行政复议决定公开的法律依据体系。The new Administrative Review Law establishes the system of making administrative reconsideration decisions public in Articles 3 and 79.The system of making administrative reconsideration decisions public is a necessary requirement for the construction of a rule of law government in the New Era,which is related to the realization of the public’s right to information and supervision.The new Administrative Review Law and related regulations do not provide detailed provisions on the scope of the content of administrative reconsideration decisions to be made public.Based on the exploration of practices in various regions,the current main issues regarding the content of administrative reconsideration decisions made public include the items to be made public,the level of detail to be disclosed,and the degree of protection of personal information in the disclosure.Additionally,it is also a pressing issue that needs to be addressed whether the results of normative document reviews in administrative reconsideration and the advisory opinions of administrative committees should be included in the scope of administrative reconsideration decisions to be made public.In order to fully leverage the effectiveness of the system of making administrative reconsideration decisions pubic,it is necessary to standardize the content of administrative reconsideration decisions to be made public,disclose the results of normative document reviews in administrative reconsideration and the adversary opinions of administrative reconsideration committees,and improve the legal basis system for making administrative reconsideration decisions public.
