地方政府主导型数据交易场所建设如何“破局”?

摘　　要：加快培育数据要素市场既是中央的明确要求,也是现实的迫切呼唤。数据交易场所是提升数据要素市场化配置效率的关键,但是,数据交易场所数量多、场内交易数据量少的困局始终未能解决。从剖析数据交易的内容特征和对治理机制的需求分析,破局的关键在于,一是充分认识“多对多交易”的市场类型最具效率,激发数据交易市场资源配置效率的关键在于推动形成“多对多交易”的市场体系;二是各地政府主导的数据交易场所应遵循全国统一的数据交易规则,并作为国家级数据交易场所的“地方频道”,实现与国家级数据交易场所的互联互通;三是构建技术标准、市场合约和法律强制三位一体的全国统一的数据交易规则迫在眉睫,以回应数据交易在交易监管、商品定价和产权界定三个方面的治理机制要求。"Accelerating the cultivation of data factor markets"is both a clear request from the Central Government and an urgent call from the reality.Data trading venues are the key to enhance the efficiency of market-based allocation of data elements,and in practice,local government-led data trading venues have set off a new wave of construction.However,the dilemma of"too many data trading venues and too little data traded on the floor"has not yet been solved.Starting from analysing the content characteristics of data transactions and the need for governance mechanisms,the article explores,based on market design theory,what kind of transaction mechanisms are more efficient,and how to implement the 20 requirements of building a regulated and efficient data trading venue.The study suggests that the key to"break the ice"lies in fully recognizing that the market type of"many-to-many transactions"is the most efficient,the crucial factor in stimulating the resource allocation efficiency of the data trading market is to promote the formation of a"many-to-many transaction"market system.Secondly,government-led data trading venues in different regions should follow the unified national data trading rules and act as"local channels"for national data trading venues,so as to achieve interconnection and interoperability with national data trading venues.Thirdly,it is urgent to build a unified national data trading rule that combines technical standards,market contracts and legal enforcement,so as to respond to the requirements of the governance mechanism of data trading in terms of transaction regulation,commodity pricing and property rights definition.
