摘　　要：2023年我国修订实施的《立法法》将“基层治理”纳入地方立法权的法定事项范围,在本质上是针对地方立法权的一种正向“再扩容”。基于此种“再扩容”的现实背景,有必要探讨其对基层治理本身产生的双重影响。一方面,积极意义体现为基层治理的非正式经验能够转化成正式制度,并且为之提供充足的法治保障,提升现阶段基层治理的制度化和理性化水平。另一方面,消极影响则表现为立法者将基层治理纳入地方立法事项之中,可能使得原本强调便捷灵活的基层治理实践陷入被动僵化的现实困境。据此,在地方立法权“再扩容”背景下推动基层治理的实践优化,应当强调法治原则的正向辐射作用,促进正式制度和非正式制度的融合交互,以及积极扩大公众参与,以提升社会可接受性。The Legislation Law amended and implemented in 2023 includes"community governance"into the scope of statutory matters of local legislative power,which is in essence a positive"re-expansion"for local legislative power.Based on the realistic background of this"re-expansion",it is necessary to explore the dual impact on the community governance itself.On the one hand,the positive significance is reflected in that the informal experience of community governance can be transformed into a formal system,and provided with sufficient safeguards under the rule of law,so as to improve the institutionalization and rationalization level of community governance at the present stage.On the other hand,the negative effect is that legislators incorporate community governance into local legislation,which may make the practice of community governance,which originally emphasized convenience and flexibility,fall into a passive and rigid reality dilemma.Accordingly,in promoting the optimization of community governance practices in the context of the"re-expansion"of local legislative power,emphasis should be placed on the positive radiation of the rule of law principle,the promotion of the integration and interaction of formal and informal systems,and the active expansion of public participation in order to enhance social acceptability.
