摘 要:表见代理情形下的卖房骗款行为虽具备“骗”的外观,但基于“表见代理是否影响刑事犯罪认定”这一问题的论争,司法实践中存在职务侵占罪与合同诈骗罪两种立场。消解实践冲突的关键在于:确定法秩序在违法性与法律效果层面的统一,通过民事规范确定此类案件中被代理人的实质被害人地位,肯定被代理人对购房者应收房款的观念占有,锚定行为人破坏被代理人对购房者债权观念占有这一事实,以职务侵占罪或盗窃罪实现此类案件在法秩序范围内的和谐统一。Although the fraudulent behavior of selling houses under the condition of apparent agency has the appearance of"fraud",there are two positions in judicial practice based on the debate on whether apparent agency affects the determination of criminal offenses:the crime of duty embezzlement and the crime of contractual fraud.The key to resolving practical conflicts lies in:establishing the unity oflegal order in terms of illegality and legal effects,determining the substantive victim status of the principal in such cases through civil norms,affirming the principal's concept of possession of the buyer's receivables,anchoring the fact that the perpetrator destroys the principal's concept of posssion of the buyer's creditor's rights,and achieving harmonious unity of such cases within the scope oflegal order through the crime of duty embezzlement or theft.
