摘　　要：2023年《立法法》的修改,增加了自贸港法规制定权的内容,这一地方立法权的合宪性得以追认。作为新生的地方立法权,自贸港法规制定权的规范行使能够完善中国特色社会主义法治体系,发挥其作为我国探索新型地方立法形态的样本作用,为海南自贸港建设提供制度支撑。检视自贸港法规制定权的行使现状,还存在立法事项边界模糊、自贸港法规立法选择次序待明确、备案审查机制不完善的问题。为了用足用好自贸港法规制定权,应明确自贸港法规制定权行使边界,明确自贸港法规立法选择次序,并完善备案审查机制,以充分发挥自贸港法规制定权的作用,保证改革与法治的协同发展。The amendment of the Legislation Law in 2023 added the content of the regulation-making power of Hainan Free Trade Port.The constitutionality of the local legislative power has been recognized.As a newly established local legislative power,the standardized exercise of the power can improve the socialist legal system with Chinese characteristics,play the role of a pioneer in the deepening reform of Hainan Free Trade Port,and provide institutional support for the construction of Hainan Free Trade Port.Upon examining the current situation of the exercise of the power,there are still issues such as unclear boundaries of legisla-tive matters,unclear selection order of the“three local legislative powers”in Hainan,and imperfect filing review mechanisms.In order to make full use of the regulation-making power of Hainan Free Trade Port,it is necessary to clarify the exercise boundaries of the power,determine the priority order of the application of Hainan’s“three local legislative powers”,and improve the filing review mechanism to fully play the role of the powers,ensuring the coordinated development of reform and the rule of law.
