公法视角下农村地区分户问题探究

摘　　要：公法视角下对分户制度的科学解释与未来发展,应当从现有实践出发,以强化公共服务理念为指引,突出分户过程中行政行为的公共价值与功能。基于分户中行政监督的现状,要逐步完善行政机关对分户中村委会的监督与问责;基于分户中行政许可的实践,要逐步明晰农户宅基地申请的操作手续,减少行政机关怠政空间;基于分户中行政确认的情形,要结合实践分类解释“户”“分户”“分户主体”等概念,加强行政确认各流程建设,实现分户制度的渐进式变迁。The scientific explanation and future development of the household separation system from the perspective of public law should start from existing practices,guided by the strengthening of public service concepts,and highlight the public value and function of administrative actions in the household separation process.Based on the current situation of administrative supervision in households,it is necessary to gradually improve the supervision and accountability of administrative organs over village committees in households.Based on the practice of administrative licensing in household registration,it is necessary to gradually clarify the operational procedures for farmers’application for homestead land and reduce the space for administrative agencies to neglect their duties.Based on the situation of administrative confirmation in household registration,it is necessary to combine practical classification to explain concepts such as“household”,“household registration”,and“household registration subject”,strengthen the construction of various administrative confirmation processes,and achieve a gradual transformation of the household registration system.
