摘　　要：现行《刑法》第241条对收买被拐卖的妇女罪的法定刑及其相关适用作出了规定,但司法实践中一些极端案例的出现也引发了学界关于本罪是否应当提高法定刑的争论,一方主张通过立法提高刑罚以增强法律震慑力,另一方则强调完善法律解释体系和加强司法力度。通过分析罪刑均衡原则、司法实践复杂性及并合主义刑法观可发现维持现行法定刑具有正当性,关键在于加强执法和司法力度,确保法律有效执行。在维持现行法定刑的基础上,更应逐步完善对于本罪的司法适用,包括准确理解刑法体系性规定、强化数罪并罚、降低证明难度引入刑事推定制度、严格把握缓刑适用、运用同类解释规则等,在现有法律框架下有效打击收买被拐卖的妇女罪,保护受害者权益。Article 241 of the current Criminal Law specifies the statutory penalties for the crime of purchasing trafficked women and its related application.However,the emergence of some extreme cases in judicial practice has sparked a debate among scholars regarding whether these penalties should be increased.One viewpoint advocates for legislative enhancement of penalties to strengthen the deterrent effect of the law,while another emphasizes the need for improvements in legal interpretation and judicial enforcement.Analysis of the principle of proportionality,the complexity of judicial practice,and the juxtapositionist view of criminal law demonstrates that maintaining the current statutory penalties is justified.The focus should be on strengthening law enforcement and judicial efforts to ensure effective implementation of the law.While retaining the current penalties,improvements in the judicial application of this crime are necessary.These include accurately understanding the systemic provisions of criminal law,enhancing the concurrent punishment for several crimes,reducing proof difficulties by introducing a system of criminal presumptions,rigorously managing probation applications,and applying the ejusdem generis interpretation rule.These measures aim to effectively combat the crime of purchasing trafficked women and protect victims’rights within the existing legal framework.
