法学案例的教育方法生成:从罗马法传统到当代中国法

摘  要:案例法在古罗马法中就已经存在并被用于法学教学与研究。古罗马法中的案例法特色源于其法学实践品格以及法学家解答作为一种重要的法源,形成“案情—问题—解答”的案例法分析步骤。案例法在中世纪呈现没落之态,出现罗马法的案例法被中断的历史情境,后又经过共同法和教会法教学得以恢复。当今世界法学案例教学的较具代表性模式有美国法的兰代尔方法、德国法的鉴定式案例分析法、日本法的要件事实论分析法,这些方法虽形式有别,但实质都是对古罗马法的案例法的知识续造。我国的案例法经历学习兰代尔方法、历史方法、推行个案全过程教学法、引进鉴定式案例分析方法等实践探索,当前需提炼出中国式法治现代化下案例法发展的模式,构建中国案例法自主知识体系以适应新时代的法学教育。Case law already existed in ancient Roman law and was used in legal teaching and research.The characteristics of case law in ancient Roman law stem from its legal practice character and jurists’answers as an important source of law,forming the analysis steps of case law from“the facts of the case—the questions—the answers”.The case law declined in the Middle Ages,and there was a historical situation in which the case law of Roman law was interrupted,and then it was restored through the teaching of common law and canon law.The more representative models of legal case teaching in the world today are the Langdale method of American law,the Gutachtensstil case analysis method of German law,and the essential fact theory analysis method of Japanese law.Although these methods are different in form,in essence they are a continuation of the knowledge of ancient Roman law case law.Chinese case law experience learning Langdale method,historical method,the implementation of the whole process of case teaching method,the introduction of appraisal case study method and other practical explorations.At present,it is necessary to refine the Chinese Modernization of the Rule of Law under the development of the model of the case law,the construction of Chinese case law of the independent knowledge system in order to adapt to the new era of legal education.
