供述障碍视域下欺骗性拒供行为矫正策略

摘　　要：欺骗性拒供行为是指犯罪嫌疑人在讯问中故意提供虚假陈述、隐瞒事实真相从而逃避供述的行为。识别犯罪嫌疑人的供述障碍有助于讯问人员化解其内心矛盾,实现使其供述的目的。从供述障碍角度分析欺骗性拒供行为,并与供述行为的驱动心理进行比较,归纳出矫正欺骗性拒供行为的总体思路,包括打击侥幸心理、提高罪责压力和降低刑罚恐惧三个方面,进而提出具体的矫正对策:打击侥幸心理包括声势震慑、证据对质和意志力竞赛三种措施;提高罪责压力包括常规说教、围绕犯罪冲动展开话题和欺骗的反作用三种措施;降低刑罚恐惧包括通过对比降低结果感知、转移注意力和循序渐进式提问三种措施。讯问人员遵循矫正对策开展讯问工作,将欺骗性拒供行为所代表的供述障碍转化为供述行为的驱动心理,借由犯罪嫌疑人心理转变达到其行为转变的目的。Deceptive denial of crime refers to the behavior of criminal suspects who intentionally provide false statements to conceal the truth and evade confession.Identifying the mental obstacles of confession represented by the behavior of criminal suspects is helpful for interrogators to resolve the inner conflicts of criminal suspects and promote them to the road of confession.By analyzing the deceptive denial of crime from the perspective of mental obstacles of confession and comparing it with the driving psychology of confession behavior,this paper summarizes the general ideas of correcting deceptive denial of crime,including combating the fluke psychology,increasing the pressure of guilt and reducing the fear of punishment.Based on these general ideas of correction work,some specific corrective measures to each general idea are proposed.There are three kinds of tactics to combat fluke psychology,which are bluff and awe,evidence confrontation and willpower competition.Increasing the pressure of guilt includes regular preaching,discussion around crime impulse and reaction of deception.Reducing the fear of punishment includes three strategies:reducing the perception of result by contrast,diverting attention and gradually asking questions.The interrogators follow the corrective strategy to carry out the interrogation work,transform the mental obstacles of confession represented by deceptive denial of crime into the driving psychology of confessional behavior,in order to achieve the purpose of behavior change through the psychological change of criminal suspects.
