认罪认罚从宽制度自愿性保障问题研究

摘　　要：以我国认罪认罚从宽制度自愿性保障为切入视角,总结了认罪认罚从宽制度的性质、作用和特点,介绍了认罪认罚从宽制度自愿性保障的现行规定和机制的概况,列举了存在立法缺失、自由选择性与固有刑诉权的救济性之间的冲突需要调和、重罪重刑案件中的自愿性保障面临挑战、较长刑事诉讼中的自愿性有效保障和态度精准定性的兼顾存在困难等问题,并逐个分析产生的原因,提出了在立法层面探索建立新型机制、创新案件办理思路、多元化改进重罪重刑案件中自愿认罪认罚保障机制、在较长刑事诉讼过程中及时审查监督等解决对策。From the perspective of the voluntary guarantee of the leniency system of guilty plea in our country,this paper summarizes the nature,function and characteristics of the leniency system of guilty plea,and introduces the current provisions and mechanisms of the voluntary guarantee of the leniency system of guilty plea.It lists some problems,such as the lack of legislation,the conflict between free choice and the relief of inherent criminal prosecution power,the challenge of voluntary protection in serious crimes,and the difficulty in balancing the effective voluntary protection and the precise and qualitative attitude in long criminal proceedings.It also analyzes the causes one by one,and puts forward solutions such as exploring the establishment of new mechanisms at the legislative level,innovating the thinking of case handling,improving the guarantee mechanism of voluntary guilty plea in serious felony cases in a diversified manner,and timely examination and supervision in the long process of criminal proceedings.
