摘　　要：《中华人民共和国刑法修正案(十一)》(以下简称《刑法修正案(十一)》)增设袭警罪,彰显了人民警察的公务活动在我国执法体系中具有的特殊地位。但是,袭警罪正式进入司法实践后对暴力袭警行为产生的遏制作用有限,执法领域的传统症结和社会发展带来的新问题都在一定程度上导致了袭警行为的高发态势。从执法层面、社会层面对袭警罪的司法适用进行重新审视,探究袭警行为发生的深层次原因,以此为基础对袭警罪的高发态势进行针对性回应,既要强化事前的有效防控,也要重视事后精准刑罚,是遏制袭警犯罪、维护法律权威的必然之举。The addition of the crime of assaulting police in the Amendments to the Criminal Law of the People’s Republic of China(XI)(hereinafter referred to as“Amendment(XI)to the Criminal Law of the People’s Republic of China”)has demonstrated the special status of the police’s official activities in our law enforcement system.However,after the crime of assaulting police officially entered the judicial practice,it did not have an effective restraining result on violent assault on police Traditional problems in the field of law enforcement and new problems brought about by social development have contributed to a certain extent to the high incidence of assaulting police.From the law enforcement level and the social level,the judicial application of the crime of assaulting police is reviewed,the deep-rooted reasons for the frequent occurrence of assaulting police are explored,and on this basis,targeted responses are made to the high incidence of assaulting police crimes.It is necessary to strengthen the effective prevention and control in advance and pay attention to the accurate punishment after the event,which is an inevitable move to curb the crime of assault on police and maintain the legal authority.
