摘　　要：安东尼·卡蒂教授《南海的历史与主权》一书通过整理、比较和分析英国、法国和美国针对南沙群岛和西沙群岛的档案资料,证实了中国自古以来在南沙群岛和西沙群岛享有主权权利的历史根据和领土主张,揭示出法国、日本、菲律宾和越南针对南沙群岛和西沙群岛权利主张的非法性、虚伪性以及美国在二战后对南海地区余留权利真空和争端根源的政治意图。该著作创新性论及历史性权利产生中的“家园”理念,批驳西方殖民主义浪潮下所形成的领土取得宣告规则,认为累世久居而逐渐取得领土主权的传统大国没有必要通告自己或其他国家。该著作为我国研究南海问题提供了客观的档案资料和中立的他国视角,并对国际海洋法相关理念和规则提供了创新思考。Professor Anthony Cartie's“The History and Sovereignty of South China Sea”confirms the historical basis and territorial claims of China's sovereignty over the Nansha Islands and the Xisha Islands since ancient times,and reveals the illegality and hypocrisy of the claims of France,Japan,Philippines and Vietnam to the Nansha Islands and the Xisha Islands,as well as the political intention of the United States to leave a vacuum of rights and dispute sources in the South China Sea after World War II.This work innovatively discusses the concept of“homeland”in the generation of historical rights,refutes the territorial acquisition declaration rules formed under the wave of Western colonialism,and puts forward that traditional great powers which have lived for a long time and gradually gained territorial sovereignty do not believe that their own land needs to be annexed,nor they need to declare sovereignty to other countries.This work provides objective archival materials and a neutral perspective from other countries for China's research on the South China Sea issue,and provides innovative thinking on relevant concepts and rules of international law.
