摘 要:完善商业数据权益保护模式有利于保障商业数据安全,促进商业数据经济价值的发挥。当下商业数据权益主要通过反不正当竞争法相关制度来保护,然而商业数据的特性导致传统反不正当竞争法的保护方式存在困境。文章讨论商业数据与传统权利客体的区分,指出当下保护路径存在的困境,在反不正当竞争法中制订商业数据专条,可以满足现实需求,为商业数据赋权保护与商业数据专门法的制定提供法律基础。Improving the protection mode of commercial data rights and interests is conducive to ensuring the security of commercial data and promoting the economic value of commercial data.At present,the rights and interests of commercial data are mainly protected through the relevant systems of anti-unfair competition law.However,the characteristics of commercial data lead to difficulties in the protection methods of traditional anti-unfair competition law.On the basis of discussing the distinction between commercial data and traditional right object,this paper points out the dilemma of current protection path.In response to the practical needs,the article on commercial data is formulated in the anti-unfair competition law,which provides a legal basis for the empowerment and protection of business data and the formulation of the special law on commercial data.
