摘 要:司法实践中,知识产权惩罚性赔偿的起算基数难以确定,并且法定赔偿与惩罚性赔偿的考量情节交叉、制度功能混同,导致前者挤压后者适用空间,此乃阻碍我国知识产权惩罚性赔偿制度科学运行的关键缘由。为化解这一困境,应从法条体系与制度功能入手,梳理二者之间的关系,取消起算基数适用顺序限制,删除权利使用费的倍数限制,重构权利使用费的适用条件。同时,厘清不同制度的功能混同,明确不同制度的适用情形,保证融合模式下将法定赔偿所确定的数额作为惩罚性赔偿起算基数的正当性与谦抑性,进而更好地实现知识产权惩罚性赔偿制度维权激励之目的,达到国家治理和社会调整的目标。The difficulty in determining the starting base for punitive damages in judicial practice,combined with the overlap between statutory compensation and punitive damages,and the confusion of their functions,results in statutory compensation squeezing the application space of the punitive damages system,which is the key obstacle to the operation of China’s intellectual property punitive damages system.To resolve this dilemma,it is necessary to clarify the relationship between punitive damages and statutory compensation,remove the restrictions on the order of application of the starting base,remove the multiple restrictions on the removal of royalties,and reconstruct the application conditions of royalties.Additionally,it is necessary to correct the confusion of functions between different systems and clarify the applicable situations of different systems to ensure the legitimacy and humility of using statutory compensation as the starting base for punitive damages under integrated mode,in order to better achieve the goal of encouraging legal protection incentives through the intellectual property punitive damages system,and reach national governance and social control goals.
