破坏野生动物资源犯罪罪名适用探讨——以野生中华蟾蜍的非法交易为例

摘　　要：办案中发现,目前部分危害野生动物资源的犯罪已经形成规模化、产业化的犯罪网络。在全面禁止食用野生动物制度确立后,为斩断利益链条,应对非法猎捕、运输、收购、加工、销售等环节进行全链条打击,并综合考量行为人的主观目的、野生动物及其制品的用途、行为对动物资源的危害程度、在犯罪链条中的作用等方面适用恰当的罪名。尤其对分散收购者,不能对其上游作机械地理解,应结合交易中食用和药用的双重价值进行全面评价。In the process of our investigation,we have found that some crimes that endanger wildlife resources have formed a large-scale and industrialized criminal web.After the mechanism established to completely ban the consumption of wild animals and in order to terminate the interest chain,we should target and combat the entire chain such as illegal hunting,transportation,purchase,processing,sales and other links.We should apply appropriate charges against the criminals after taking into comprehensive consideration their subjective purpose,usages of wild animals and products,the degree of harm to animal resources caused by their behavior,and the role in the criminal chain.Especially to those scattering purchasers,we cannot mechanically refer to their behavior as upstream link,and should conduct a comprehensive evaluation based on the dual value for food purpose or medical one in the transaction.
