网络贩毒案件的侦查难点与对策研究

摘　　要：随着信息化时代的到来,传统贩毒犯罪逐步转变为网络贩毒犯罪,严重危害着我国公共安全和社会稳定。研究其现状,可以发现网络的隐蔽性加之毒品交易追求的高利润、低风险等特点导致贩毒人员将毒品贩卖的主战场从现实空间蔓延至虚拟空间,使得网络贩毒成为了传统贩毒模式的升级版本,这给侦查造成了极大的困扰,侦查机关面临着缉毒线索发现难、犯罪嫌疑人缉捕难、证据收集和证明难以及侦查协作开展难等诸多难题。对此,侦查机关要从建立信息共享机制、加强网络管理、注意侦查取证的合法性以及以寄递公司为突破口构建侦查协作格局等方面入手,达到能够预先控制、案后速控、动态追踪、深挖犯罪的侦查效果。With the advent of the information era,traditional drug trafficking has gradually converted into online drug trafficking,which seriously endangers public safety and social stability in our country.By studying its current situation,we have found that such characteristics as concealed web,high profits and low risks pursued by drug trade,have led drug traffickers to move the drug trafficking from the realistic space to the virtual space,which makes online drug trafficking an upgraded version of the traditional drug trafficking model.This has caused great trouble to the criminal investigation.The investigation departments confront many problems such as difficulties in finding drug clues,arresting suspects,collecting and testifying evidence,and investigation cooperation.Accordingly,investigative agencies should start with the establishment of information sharing mechanisms,reinforcement of Internet management,attention paid to the legality of investigation and evidence collection,and reliance on delivery companies and then establish an investigation cooperation mode so as to have investigation effects of pre-control,post-case rapid control,dynamic tracking and deep exposure of crimes.
