摘 要:《刑法修正案(十一)》调整了强令、组织他人违章冒险作业罪的适用范围,将原来的单一罪名修改为选择性罪名。在具体的司法适用过程中应当注意本罪的主观方面起码是间接故意,在判定是否存在(重大)事故隐患时应当参照前置的行政法律法规进行实质判断。强令他人违章冒险作业罪的核心要义是违背他人意愿,至于他人意愿的具体内容不应当成为阻却行为人成立本罪的构成要件要素。组织他人违章冒险作业罪罪状描述中的“不排除”应该理解为未能有效排除,在判断行为人是否构成本罪时要审查重大事故隐患是否一直存在。The Eleventh Amendment to the Criminal Law has readjusted the range of applicability for the crime of forcing and organizing others to engage in illegal and risky operations,and changed the original single charge to selective charges.In the practical judicial application process,attention should be paid to the subjective aspect of this crime,which is at least an indirect intentional crime.When determining whether there are potential hazards of (serious) accidents,judicial officers should make substantive judgment by referring to the preceding administrative laws and regulations.The core essence of the crime of forcing others to violate regulations to engage in risky work is to go against the others’ will,and the specific content of the others’ will should not be a constituent element that hinders the perpetrator from establishing this crime.The term "not excluding" in the description of the crime of organizing others to engage in illegal and risky work should be understood as failing to effectively exclude it.When judicial officers are determining whether the perpetrator constitutes this crime,it is necessary to investigate whether major accident hazards have existed all the tine.
