档案治理视域下、《档案法》与《民法典》的衔接

摘　　要：推进档案治理体系与治理能力现代化需要公法与私法的共同协力,应充分发挥《民法典》的重要参与作用。《档案法》中也预留了《民法典》参与档案治理的路径。《档案法》与《民法典》的衔接机制,主要表现为依循《档案法》立法目的适用《民法典》,以及借鉴《民法典》方法论适用《档案法》。为进一步深化《档案法》与《民法典》的衔接,推动《民法典》参与档案治理,应结合档案治理中的现实情况与问题导向进一步解释、细化《民法典》规范,并完善相应的配套制度。对此,需要厘清档案主管部门权责清单,推动档案事业多元共治;需要健全非营利法人规范体系,助力社会力量参与和支持档案事业;需要明确档案服务外包合同性质,推进档案事业专业化发展;需要合理适用民事责任方式,保障相关主体档案民事权益。To promote the modernization of archival governance system and governance capacity requires the joint efforts of public law and private law,and the important participation role of Civil Code should be brought into full play.The Archives Law also reserves the path for the Civil Code to participate in archive governance.The connection mechanism between the Archives Law and the Civil Code is mainly manifested in the application of the Civil Code in accordance with the legislative purpose of the Archives Law,as well as the application of the Archives Law based on the methodology of the Civil Code.In order to further deepen the connection between the Archives Law and the Civil Code,and promote the participation of the Civil Code in archive governance,it is necessary to further explain and refine the norms of the Civil Code based on the practical situation and problem orientation in archive governance,and improve corresponding supporting systems.In this regard,it is necessary to clarify the list of powers and responsibilities of the archives administration department,so as to promote the multi-governance of archives undertakings;It is necessary to improve the legal system of non-profit legal persons to help social forces participate in and support archival undertakings;It is necessary to clarify the nature of archives service outsourcing contract to promote the professional development of archives.It is necessary to reasonably apply civil liability methods to protect the civil rights and interests of relevant subjects.
