学位档案条款的法理检视与规范解释——基于《学位法》第三十条的分析

摘　　要：学位档案治理法治化是学位授予全过程管理的关键环节和档案治理现代化的重要组成,具有存史资政育人之益,对于建设教育强国、服务社会发展、培养新生力量均有重要效能。就内部体系而言,学位档案条款蕴含分级分类管理、完整与安全相统一、保护和利用相均衡等法律原则;就外部体系来看,学位档案条款主要是从档案管理主体、归档义务主体、涉密学位档案认定等维度就其形式逻辑加以展开。未来制定的“中华人民共和国学位法实施条例”宜进一步对其责任配置、密级认定、保存期限等迫切问题予以细化。The legalization of the degree archives management is the key link of the whole management process of the degree conferment and the important component of the modernization of archives management,which has the benefits of preserving history,informing politics and educating people,and has important effects on the construction of a strong educational country,serving social development and cultivating new forces.In terms of the internal system,clauses on academic degree archives embody legal principles such as hierarchical and classified management,unity of integrity and security,and balance between protection and utilization;in terms of the external system,clauses on academic degree archives mainly elaborate on their formal logic from the dimensions such as the subject of archive management,the subject of filing obligations,and the identification of confidential academic degree archives."Regulations on the Implementation of the Academic Degrees Law of the People's Republic of China"should be further detailed on the distribution of responsibilities,the classification of secrecy,the retention period and other urgent issues in the future.
