摘　　要：“隔空猥亵”是传统猥亵犯罪行为在网络环境中的新发展样态,其以儿童为侵害对象,严重影响儿童身心健康。当前,关于“隔空猥亵”的研究多集中于行为定性和量刑方面,对于动态的司法追诉实践关注较少。针对“隔空猥亵”面临的“证明难”问题,需要不断拓展研究空间,优化证据结构,加强对涉案犯罪嫌疑人全方位和立体式的调查,适用综合型证明模式,实现证明突破。“隔空猥亵”案件治理一要坚持系统思维,拓展治理视野,从社会学角度深入剖析犯罪诱因,调动和组织多元主体参与网络环境营造和未成年人保护活动,提高未成年人自身的防范意识。二要通过技术赋能加强执法机关的风险识别和预警能力,提高关键证据提取和固定水平,进一步提升“隔空猥亵”案件治理效果,实现司法治理能力现代化。None-contact indecency on network is a new type of such offence different from the traditional physical form.Its victims are children and it brings serious damage to children's physical and mental health.The current study of none-contact indecency mainly focuses on the qualitative analysis of the acts and penalty discussion,while pays less attention to the dynamic judicial practice.As to the difficulties in obtaining evidence in such offence,the study should expand its scope to optimize the evidence structure,realize an overall and dimensional investigation of the suspects involved,and apply with the comprehensive proof mode.The governance of none-contact indecency should persist in the system thinking and enlarge the view,profoundly analyzing the causes from the sociology,encourage more parties participate in creating the preferable cyber environment and protecting the juveniles.Besides,the technology should be used to enhance the risk identification and warning capability of the law enforcement agency,and to extract and fix the critical evidence,so as to improve the governance effects of non-contact indecency and realize the modernization of judicial governance capacity and governance system.
