图书馆数字文献传递的著作权侵权表现及对策研究——基于公开民事判决书的实证分析

摘　　要：图书馆数字文献传递易被诉侵害他人著作权,这成为图书馆必须面对的重要问题。基于中国裁判文书网中322份图书馆数字文献传递著作权侵权纠纷民事判决书的分析发现,图书馆与数据库提供商被列为共同被告、双方被诉侵犯复制权和信息网络传播权以及图书馆抗辩成功率较低的情况突出。进一步分析发现,提供含有作品内容的链接和通过图书馆本地数据库镜像提供作品是图书馆被认定构成直接侵权的原因;以定向链接方式提供侵权帮助和与数据库提供商之间建立合同关系是图书馆被认定与他人成立共同侵权的重要因素。对此,建议图书馆以普通链接方式参与数字文献传递,积极审查数据库内电子文献授权情况,选择数据库提供商所提供的技术服务而非技术服务加产品销售。Digital document delivery in libraries is prone to copyright infringement lawsuits,making it a significant issue that libraries must address.An analysis of 322 civil judgments on copyright infringement disputes related to digital document delivery in libraries,sourced from the China Judgments Online,reveals that libraries and database providers are frequently listed as co-defendants.Both parties are often accused of infringing reproduction rights and information network transmission rights,with libraries rarely succeeding in their defenses.Further analysis shows that providing links containing the content of works and offering works through local database mirrors are the reasons for libraries being found directly liable for infringement.Assisting in infringement through directed links and establishing contractual relationships with database providers are key factors leading to findings of joint infringement.It is recommended that libraries participate in digital document delivery using regular links,actively review the authorization status of electronic documents within databases,and opt for technical services offered by database providers rather than a combination of technical services and product sales.
