摘　　要：近年频发的虐待动物事件严重侵害动物的生存权和福利,反映出我国在动物保护方面法律体系尚不完善,存在诸多亟待解决的问题。相较于西方国家在动物保护立法方面取得的显著进步,我国在动物保护方面仍存在法律上的空白。相比于刑事、民事立法,行政法具有的灵活性、高效性、贯穿性使其在动物保护上更具合理性,但现行的行政法在动物保护上亦存在诸多问题,该文通过对现有动物保护行政法律体系的系统梳理和深入分析,探究行政法在规制虐待动物行为中的作用与不足,并提出相应的完善建议,推动我国动物保护行政法立法的完善,推进人与自然的和谐共生。Frequent animal abuse incidents in recent years have seriously infringed on the animals'right to life and welfare,reflecting that China's legal system in animal protection is still imperfect,and there are many urgent problems to be solved.Compared with the significant progress made by Western countries in animal protection legislation,China still has legal gaps in animal protection.Compared with criminal and civil legislation,the flexibility,efficiency,and penetration of administrative law make it more reasonable in animal protection.However,the current administrative law also has many problems in animal protection.Therefore,this article explores the role and deficiencies of administrative law in regulating animal abuse through a systematic review and in-depth analysis of the existing animal protection administrative legal system.And put forward corresponding improvement suggestions to promote the improvement of China's animal protection administrative law legislation and promote the harmonious coexistence between human and nature.
