摘 要:交通失序是城市治理的巨大障碍及社会治理者需要解决的棘手问题,值得理论界与实务界深入探讨相关对策。聚焦以集中治理交通问题为目的的“交通整治大会战”惯常治理模式,分析其可能存在的诸多隐患,阐明交通失序的客观根源,评介其他国家和地区交通失序治理的有益经验,从法学理论的视角进行剖析并倡导法治理模式转换,最终提出明确树立法治理模式导向、同步落实宏观政策与微观政策、充分兼顾交通设施与交通制度建设等建议。Traffic disorder is a huge obstacle to urban governance and a thorny problem that social governors need to solve in the future.The relevant countermeasures are worth in-depth discussion by the theoretical and practical circles.This article focuses on the conventional governance model of the“traffic improvement campaign”aimed at centralized governance of traffic problems,analyzes the many hidden dangers that may exist in this governance model,and clarifies the objective roots of traffic disorder.Based on the review of the beneficial experience of traffic disorder governance of other countries and regions,and the analysis of legal governance models from the perspective of legal theory,it proposes such policy tendencies as the establishment of a legislative governance model,the synchronous implementation of macro and micro policies,and the consideration of transportation facilities and transportation institutional construction.
