未来产业创新生态培育的知识产权战略研究

摘　　要：未来产业是我国“十四五”规划明确提出的重要概念,涉及具有引领前沿科技和颠覆性技术、共性技术的重大科技创新及其产业化孵化等内容,是当前国际竞争的高地,也是我国发展新质生产力的重要方面。未来产业发展立足于良好的创新生态系统,该系统需要采取有效手段和策略加以构建。基于知识产权在法律上具有独占权的属性,在经济学上具有生产要素、经营资源和无形资产的特质,以及在开展市场竞争上具有战略意蕴,我国未来产业创新生态培育,需要站在战略高度,充分运用知识产权战略,从知识产权创造、知识产权保护、知识产权运用和知识产权管理战略方面全方位推进。The future industry is an important concept explicitly proposed in China’s14th Five Year Plan,which involves major technological innovations and industrial incubation that lead cutting-edge technology,disruptive technology,and common technology.It is currently a highland of international competition and an important aspect of China’s development of new quality production capacity.The future development of industries is based on a sound innova⁃tion ecosystem and this ecosystem needs to be nurtured through effective means and strategies.Based on the exclu⁃sive property rights of intellectual property in law,the characteristics of production factors,business resources,and intangible assets in economics,and the strategic implications in market competition,the cultivation of China’s fu⁃ture industrial innovation ecology needs to stand at a strategic height,fully utilize intellectual property strategies,and comprehensively promote intellectual property creation,protection,utilization,and management strategies.
