摘　　要：回顾我国地方金融监管的权力配置演进史,以“一级政府,一级监管”为特征的地方金融监管模式导致了金融发展与金融监管双目标冲突以及地方金融监管事权划分不合理等问题,由此造成地方金融监管权力配置的困境。究其背后的原因,主要是我国地方金融监管权力配置缺乏法律的顶层设计,体制上的金融放权范式取代了法律上的金融分权范式。在我国新一轮金融监管机构改革的背景下,推进地方金融监管法治化的关键是将地方金融监管体制的改革经验以法律形式加以巩固,并在金融监管组织法的框架下明确央地金融事权的划分标准,完善央地金融监管的协调机制,持续优化地方金融监管决策程序与实施过程,建立健全地方金融监管的行政问责制度。Reviewing the evolution of the power allocation of local financial supervision in China,the local financial supervision model,characterized by"one level of government,one level of supervision",presents problems such as the conflict between the dual objectives of financial development and financial supervision and the irrational division of local financial supervision authority,which leads to the dilemma of the power configuration of local financial supervision.The main reasons behind these problems are the lack of overall legal system design to the power allocation of local financial supervision,and the institutional paradigm of financial power delegation has replaced the legal paradigm of financial power decentralization.Under the background of China's new round of the reform of financial regulatory institutions,the key to promoting the rule of law in local financial supervision is to consolidate the reform experience of the local financial supervision system in the form of law,to improve the coordination mechanism between central and local financial supervision,to clarify the legal standards for the division of financial supervision affairs between the central and local authorities under the framework of the Organic Law on Financial Supervision,to continually strengthen the decision-making procedures and implementation process of local financial supervision,and finally to establish and improve the system of administrative accountability for local financial supervision.
