摘　　要：2017年10月18日,习近平总书记在十九大报告中指出:目前我国社会主要矛盾已经转化为人民日益增长的美好生活需要和不平衡不充分的发展之间的矛盾。这条报告向我们揭示出,在未来与人民美好生活的需求最息息相关公共服务的需求,需要借由市场和社会合作进行提供。目前随着数字经济的发展,这种“类公共型服务”的提供首先反映在第三方支付领域,在第三方支付领域出现的电子货币、沉淀资金的擎息分配问题都是此类问题的缩影,笔者希望借由对此类问题的分析和建议,从而区分“类公共性物品”的群体利益、创设新的维权方式、分配社会责任,从而对于数字经济的发展和“类公共服务”的提供提供参考。From the beginning of the third-party payment platform,we can find that the two characteristics of private and public continue to grow with the third-party payment platform.In the contradiction of settling funds in recent years,we can see through the window of third-party payment:with the gradual development of ecommerce,the platform that meets a certain number of users has produced a certain scale or the same or different social interests based on the different number of users.This not only gradually requires the third-party platform to bear certain social responsibilities,but also requires the law to give a determined subject to adjust the relationship of social interests.Based on this,we need to conduct in-depth research on the precipitation funds.
