摘　　要：逐年增加的高校应届毕业生让大学生就业与创业问题愈发凸显,政府、高校均在不断出台系列政策文件贯彻落实大学生就业优先战略。然而,大学生就业创业中涉嫌的刑事犯罪无不在提醒相关政策的推进与鼓励,不能以忽略法律风险、无视法治红线为代价。归纳研究大学生就业创业中常见的刑事风险,分析其背后的成因,提出法治教育与服务体系的完善策略,从而帮助大学生尽可能化被动为主动,将就业创业中的刑事法律风险从事后救济转变为事前预防和规避。The increasing number of college graduates year by year makes the problem of college students'employment and entrepreneurship more prominent.The government and colleges and universities are constantly issuing a series of policy documents to implement the strategy of college students’employment priority.However,the suspected criminal crimes in the employment and entrepreneurship of college students all remind the promotion and encouragement of relevant policies,which cannot be at the cost of ignoring legal risks and ignoring the red line of the rule of law.The common criminal risks in employment and entrepreneurship of college students are summarized and studied,the causes behind them are analyzed,and the strategies for improving the legal education and service system are proposed,so as to help college students turn passivity into initiative as much as possible,and transform the relief after the criminal legal risks in employment and entrepreneurship into prevention and avoidance in advance.
