论侦查关键线索的几个问题

摘　　要：侦查关键线索,是以各种形态呈现、被侦查人员所认知并据此开展侦查能够使案件突破的关键涉案事实。有效地发现、选择和利用侦查关键线索至关重要,它受侦查能力的制约,一部分可转化为关键证据,具有个案的特殊性及多重连环性。侦查关键线索通常以关键的“人”“物”“时”“空”“事”及其衍生事实体现出来。侦查关键线索的发现与选择应该以“全覆盖无遗漏”与“效益优先”为原则,从最明显或急需澄清与解决之处、细微隐潜之处、案犯易疏忽或侦查易遗漏之处入手;在利用这些线索时,要精心策划并尽快落实行动,同时积极寻求新线索,并根据实际情况及时调整侦查方案。The key clues of investigation,presented in various forms,recognized by investigators who have used them to carry out investigations,are the key facts involved in the case.It is crucial to effectively discover,select,and utilize key clues of investigation.It is constrained by investigative capabilities and can be partially transformed into key evidence,which have the specificity and multiple links of individual cases.The key clues of investigation are usually reflected in the key"people","things","time","space","events"and their derived facts.The discovery and selection of key clues should be based on the principles of"full coverage without omission"and"priority of benefits",starting from the most obvious or urgent areas that need clarification and resolution,subtle hidden areas,and areas where criminals are prone to neglect or investigators are prone to omit.When utilizing these clues,it is necessary to carefully plan and implement actions as soon as possible,actively seek new clues,and adjust the investigation plan in a timely manner according to the actual situation.
