摘 要:区块链以技术赋能方式引发行业变革并催生新业态,形成赋能万事万物格局。文章基于技术赋能视角,以知识产权生命周期、知识产权生态系统为理论基础,沿着“技术赋能—机理解构—路径探索”研究主线,以数字时代知识产权保护与发展面临的困境为研究起点,基于TOE框架探析区块链与知识产权的逻辑适配;聚焦区块链技术赋能知识产权全生命周期管理的机理,探析技术赋能模型及赋能后知识产权生态系统的表征;将区块链技术与知识产权全生命周期管理深度融合面临的风险表征于PESTEL框架内,从认知、应用、制度及保障等层面拓展区块链技术赋能的边界。In the era of globalization,interconnection,and digitalization,the protection and development of intellectual property(IP)has become more challenging.Due to its technological advantages,blockchain technology has triggered industry changes and introduced new business models,forming a new development pattern in which“blockchain empowers everything”.From the perspective of technology empowerment,this article explores the logical fit between blockchain technology and intellectual property rights using the TOE framework,following the research line of“technology empowerment-mechanism deconstruction-path exploration”based on the theories of IP life cycle and IP ecosystem.It highlights the mechanism of blockchain technology empowering IP life cycle management,and explores the technology empowerment models and characteristics of the empowered IP ecosystem.Focusing on the risks when blockchain technology is deeply integrated with IP life cycle management,the study presents the risks under the PESTEL framework,thus expanding the theoretical boundaries of blockchain technology empowerment in terms of cognition,application,system,and safeguards.
