强制隔离戒毒检察监督的嬗变与重构

摘　　要：《禁毒法》颁布实施以来,我国形成了全新的戒毒体系。但由于立法的缺失以及配套制度的不完善,检察权在强制隔离戒毒中的运用长期受到制约,造成了检察监督的盲点和空白,影响了检察机关的监督意愿和监督实效。强制隔离戒毒的根本目的在于消解戒毒人员的人身危险性和增加其再社会化的能力,维护戒毒人员合法权益不受减损,是强制隔离戒毒检察监督的首要价值考量。为使强制隔离戒毒活动有序运作,保障戒毒人员的合法权益,完善立法是强制隔离戒毒检察监督的必由之路。需以问题为导向,从权利本位出发,通过确立检察机关的法律监督地位,明确监督的内容和方式,加强对戒毒人员的权益保障,推动整体立法实现执法全过程监督。强制隔离戒毒机关要由被动监督向主动接受监督转变,通过优化检察机关的监督方式,确保监督落到实效。重构以检察监督为主的多元监督新路径,落实检察机关法律监督的宪制机能。Since the promulgation and implementation of the Drug Control Law,China has formed a new drug treatment system.However,due to the lack of legislation and the imperfection of supporting system,the application of procuratorial power in compulsory isolation of drug rehabilitation has been restricted for a long time,resulting in the blind spot and blank of procuratorial supervision,affecting the procuratorial organ s supervision willingness and effectiveness.The fundamental purpose of compulsory isolation for drug rehabilitation is to eliminate the personal danger of drug rehabilitation personnel and increase their re-socialization ability,and to protect the legitimate rights and interests of drug rehabilitation personnel,which is the primary value consideration of compulsory isolation for drug rehabilitation supervision.In order to make the compulsory isolation drug rehabilitation activities operate in an orderly manner and protect the legitimate rights and interests of drug rehabilitation personnel,improving legislation is the only way for the compulsory isolation drug rehabilitation supervision.We need to take the problem as the orientation and start from the right standard,clarify the content and way of supervision through establishing the legal supervision status of procuratorial organs,strengthen the protection of the rights and interests of drug addicts to promote the overall legislation and realize the supervision of the whole process of law enforcement.The compulsory isolation drug rehabilitation organs should transform from passive supervision to active supervision,and ensure the effective supervision by optimizing the supervision methods of procuratorial organs.The new path of multiple supervision should be reconstructed based on procuratorial supervision,to implement the constitutional function of procuratorial organs legal supervision.
