反垄断视角下数字音乐版权市场的治理困境与出路

摘　　要：【目的】音乐版权关系着市场竞争格局与发展状况。在后独家时代背景下,厘清独家授权模式与平台垄断的关联、取消该模式的后果以及数字音乐版权市场的现实困境具有理论和实践上的重要意义。【方法】以反垄断为视角,从数字音乐平台垄断性成因入手,梳理数字音乐版权市场的治理困境,从制度、业务、技术等方面提出解决方案。【结果】数字音乐版权市场仍存在因转授权不彻底形成变相垄断、“寡头垄断”的影响尚未消解、新型音乐侵权频发的治理困境,需要采取一系列措施予以规制,从而促进数字音乐版权市场的良性竞争。【结论】分别从制度策略、业务策略、技术策略等方面,提出了多种法律共同规制、多元化业务拓展、运用技术对抗侵权现象等治理措施。[Purposes]Music copyright is related to market competition pattern and development status.Under the background of post-exclusive era,it is of great theoretical and practical significance to clarify the relationship between exclusive licensing model and platform monopoly,the consequences of abolish-ing this model and the realistic dilemma of digital music copyright market.[Methods]From the perspec-tive of anti-monopoly,this paper starts with the causes of monopoly of digital music platforms,sorts out the governance dilemma of digital music copyright market,and puts forward solutions from the aspects of system,business and technology.[Findings]There are still some governance dilemmas in the digital mu-sic copyright market,such as the disguised monopoly formed by incomplete authorization,the influence of“oligopoly”not been eliminated,and the frequent occurrence of new music infringement.It is necessary to take a series of measures to regulate those dilemmas,so as to promote the healthy competition in the digital music copyright market.[Conclusions]From the perspective of system,business and technology strategies,this paper puts forward measures like a variety of legal joint regulation,diversified business expansion,and the use of technology to combat infringement.
