摘　　要：在世界范围内,加密资产交易平台因掌握代码技术,并与平台用户达成服务协议,从而获得了制定交易规则、管理交易行为和解决交易纠纷的强大权力,成为了公权力监管的重要补充力量。然而,利益至上观念的诱导和外部约束机制的缺失,导致交易平台在行使权力时更注重平台自身效益,难以兼顾公平正义,给全球投资者带来了巨大的经济损失,并严重威胁交易市场安全。为纠正权力行使方向及权力异化趋势,需明确加密资产交易平台的公共性定位,在此基础上,要求交易平台回应社会公众的利益和愿望,承担保护投资者权益和维护社会公共利益的社会责任,合理制定交易平台规则,忠实勤勉开展交易平台活动,公正处理用户争议纠纷,并通过全面的公权力监管和行业自律,督促交易平台履行责任,进而实现规制平台权力的目标。Around the world,Crypto-asset trading platforms have gained strong power to formulate trading rules,manage trading behavior and resolve transaction disputes by possessing the coding technology and reaching service agreements with platform users,thus becoming an important supplementary force to public power in supervising the cryptocurrency market.However,the inducement of the“profit first”concept and the lack of an external constraint mechanism have led trading platforms to prioritize their own benefits when exercising power,making it difficult to balance fairness and justice,causing huge economic losses to investors and seriously threatening the security of the trading market.In order to rectify the direction of the exercise of power and counteract the trend of power alienation,it is necessary to clarify the public positioning of the crypto-asset trading platform.It requires the trading platforms to respond to the interests and aspirations of the public,assume the social responsibility of protecting the investors’rights and safeguarding the public interest,reasonably formulate the rules of the trading platform,diligently conduct platform activities,impartially handle user disputes,and urge the trading platform to fulfill its responsibilities through comprehensive public power supervision and industry self-discipline,ultimately achieving the goal of regulating the power of platforms.
