关于药物用途发明中涉及作用机理的用途的可专利性研究

摘　　要：文章结合专利申请实务中的典型案例,参考审查指南相关内容以及目前的专利审查实践,分析讨论了药物用途发明中涉及作用机理的用途的可专利性。通过详细分析讨论,总结出当前情况下会出现的审查情形和可供参考的应对方式,并提出今后的审查改进方向。目前阶段将作用机理结合具体用途比较容易获得授权保护,但从长远来看,为了保护申请人的权利和促进生物医药领域的创新,可适当放宽标准从而对一部分特定的“作用机理”本身进行保护。Based on typical cases in patent application practice,with reference to the relevant contents of the Guidelines for Patent Examination and the current examination practice,the article discusses the patentability of use invention refer to mechanisms of medicine.Through the analysis and discussion,it summarizes several examination results that will occur in the current situation and how to respond to it for referen ce,and proposes the direction for improvement of future examinations.At the present stage,it is relatively easy to obtain the grant of protection by combining the mechanisms of medicine with specific use,but in the long run,in order to protect the rights of applicants and promote innovation in the field of biopharmaceuticals,the standards may be appropriately relaxed to protect some specific“mechanism of action”itself.
