利益平衡视角下民间文学艺术作品版权主体之认定

摘　　要：民间文学艺术作品所涉主体利益的复杂性造成归属确定困难,公共利益、群体利益与传承个体利益的交叉对立阻碍着民间文艺作品主体资格的认定。民间文艺作品版权归属的认定首先要分析各主体的利益正当性,结合民间文学艺术作品的创作特点与版权基本理论确定群体与传承个体二元复合主体论,并以个体与文化生态的内在联系为依据划分成内育性传承人与外生性传承人。基于内育性传承人的族群身份,应以是否脱离文化生态为标准划分民间文艺作品与衍生作品。在利益平衡指导下,采用限制主体权利与经济补偿的机制均衡权利人与使用者利益;外生性传承人与内育性传承人享有衍生作品版权,但应尊重本体作品并向权利人支付报酬;内育性传承人未脱离质的作品权利归属于群体,传承人可享有署名权与经济利益。The complexity of the interests of the folk literature subjects makes it difficult to determine the attribution,and the cross-opposition between public interests,local communities interests and individual interests of inheritance hinders the subject identification of folk literature.The determination of copyright ownership of folk literature should first analyze the legitimacy of the interests of each subject,combine the creative characteristics of folk literature with the basic theory of copyright to determine the binary composite subject theory of the local communities and the inherited individual,and divide the individual into endogenous inheritors and exogenous inheritors based on the intrinsic connection between the individual and the cultural ecology.Based on the community identity of the endogenous inheritors,folk literature should be divided into folk works and derivative works based on whether they are separated from the cultural ecology or not.Under the guidance of balancing interests,the mechanism of restricting the rights of the main body and economic compensation shall be adopted to balance the interests of right holders and users;exogenous inheritors and endogenous inheritors shall enjoy the copyrights of derivative works,but they shall respect the original works and pay remuneration to the right holders;and the rights of the works of endogenous inheritors that are not detached from the nature shall be attributed to the group,and the inheritors shall enjoy the right of authorship and economic interests.
