摘 要:《行政处罚法》第三十三条明确了不予行政处罚制度。这一制度经法律确立之后,各领域结合相关法律规定积极探索如何具体适用。在生态环境领域,这一制度是平衡环境领域的利益冲突、推进公私合作环境治理、促进环境重惩体系轻缓化实施的重要举措。然而,生态环境领域不予行政处罚制度起步较晚,目前正处于高速发展阶段,还有极大的空间需要进行完善。从现有实践来看,我国生态环境领域不予处罚制度在适用的过程中,仍然存在轻微违法认定的模糊性、免罚清单适用的机械性、教育程序规范的欠缺性等问题,亟需从明确不予行政处罚行为构成要件的内涵、完善生态环境免罚清单制度、规范不予处罚的教育程序等方面对其进行完善,以保证这一制度在法治轨道上平稳运行。The system of non punishment in the field of ecological environment is based on the particularity of the ecological environment,effectively alleviating the system of heavy environmental penalties,promoting public-private cooperation in environmental governance,and promoting the balance between ecological and economic interests.From the existing practice,it can be seen that the non punishment system in the field of ecological environment in China still faces problems such as ambiguity in the recognition of minor violations,the mechanical application of the exemption list,and lack of education program norms.It is urgent to improve it from the aspects of clarifying the connotation of the constituent elements,improving the ecological environment exemption list system,and regulating the non punishment education program.
