论我国限制加重原则量刑规范化的路径构建

摘　　要：为实现量刑规范化目的,限制加重原则的裁量过程需要明确具体的规范指引。司法数据表明,沿革并改良限制加重原则既有的地方规范模式难以实现量刑规范化的应然目的,需要按照量刑规范化的一般逻辑,通过厘清情节范畴和明确情节适用的方式展开限制加重的量刑规范化制度构建。就量刑情节范畴而言,刑期考量说与独立考量说均应当作为限制加重原则的量刑情节范畴,刑期考量说的情节设计可以从“递减模式”出发;独立考量说的情节设计则应围绕行为人的犯罪频率、主观态度及所犯数罪间的法益差异展开。就量刑情节适用而言,应参照《关于常见犯罪的量刑指导意见》等规范性文件的具体流程,以“基准刑-宣告刑”作为基本的情节适用逻辑,将既有情节在明确效用的基础上予以分门别类,从而建构符合量刑规范化要求的具体裁量模式。In order to achieve the purpose of sentencing standardization,the process of discretionary principle of limiting aggravation,which is currently not regulated by a central norm,needs guidance.From the perspective of judicial data,it is difficult for the local regulatory model of the principle of limiting aggravation to achieve its due purpose of sentencing standardization;therefore,the construction of a sentencing standardization system needs to be carried out in accordance with the general logic of sentencing standardization by clarifying the scope of the circumstance and clarifying the application of the circumstance.As far as the scope of circumstances is concerned,the independent consideration and sentence consideration currently advocated by academics should be used as the scope of circumstances the principle of limiting aggravation.As for the application of circumstances,reference should be made to the sentencing procedures of the Guidelines on Sentencing for Common Crimes,with‘base sentence-pronounced sentence’as the basic logic of discretion,and the existing circumstances categorized and their utility clarified,so as to ultimately construct a mode of discretion that meets the requirements of the sentencing standardization.
