中国近海渔业资源保护法律规制研究

摘　　要：中国近海渔业资源持续衰退,亟待进一步完善近海渔业资源保护的法律法规与制度措施进行规制。梳理中国近海渔业资源保护的法律法规以及具体制度,发现中国近海渔业资源保护法律规制方面存在不足,包括近海渔业资源保护立法目的存在偏颇、立法缺乏统筹性、立法存在缺失、执法监督体系存在漏洞以及近海渔民权益保障机制不健全等。从丰富近海渔业资源保护的立法目的,构建近海渔业资源保护法律体系,填补近海渔业资源保护立法缺陷,完善近海渔业资源保护执法监督体系以及强化近海渔民权益保障机制建设等方面解决中国近海渔业资源保护法律规制不足的问题,促进中国近海渔业资源可持续开发与利用。China's coastal fishery resources continue to decline,and it is urgent to further improve the laws,regulations and institutional measures for the protection of coastal fishery resources.This paper reviews the laws,regulations and specific systems for the protection of coastal fishery resources in China,and finds that there are deficiencies in the legal regulation of the protection of coastal fishery resources in China,including the biased legislative purpose of the protection of coastal fishery resources,the lack of overall planning of legislation,the lack of legislation,the loopholes in the law enforcement supervision system,and the imperfect mechanism for protecting the rights and interests of coastal fishermen.To solve the problem of insufficient legal regulation of China's offshore fishery resources protection from the aspects of enriching the legislative purpose of offshore fishery resources protection,,building a legal system for the protection of offshore fishery resources,filling the legislative deficiencies of the protection of offshore fishery resources,improving the law enforcement and supervision system for the protection of offshore fishery resources,and strengthening the construction of the mechanism for protecting the rights and interests of offshore fishermen,to promote the sustainable development and utilization of China's offshore fishery resources.
