论司各特小说中的冤狱书写与法律理想

摘　　要：沃尔特·司各特是一位从事法律职业的著名作家,他在自己的文学创作中,充分表达了对法律问题的认知。尤其在其长篇小说《密得洛西恩监狱》中,司各特通过冤狱事件的书写,体现了他作为文学家和法学家的双重身份,以及对法律伦理的审视。本文拟从推定判罪的死刑错案、“艾菲冤狱”的渊源与实质,以及珍妮·迪恩斯这一道德楷模所体现的浪漫的法律理想等三个方面入手,探究司各特作品中冤狱书写的特质,以及从中所呈现的法律思想。在司各特的冤狱书写中,既有对当时不合理的法律制度以及法律审判程序的批判,也有对处于伦理困境之中的犯罪嫌疑人心理状态的关注,还有对理想人物的性格塑造,从而在冤狱书写中贯穿着文学的伦理教诲功能以及对司法正义的理想企求。Walter Scott,a renowned British writer who also pursued a career in law,often reflected his astute understanding of legal matters in his literary works.His novel,The Heart of Midlothian,showcases his dual identity as both a novelist and a legal professional,as he explores legal ethics through the unjust condemnation of the character,Effie.This paper explores the qualities of Scott's narrative on the unfair trials and the legal ideals presented in his work from three aspects:the wrongful presumptive conviction,the origins and essence of"the unfair trial of Effie,"and the portrayal of Jenny Deans as an ideal moral example.In Scott's legal writings of unfair trials,there are criticisms of the irrational legal system and legal trial procedures at that time,as well as concerns about the psychological state of the criminal suspects in ethical dilemmas,and characterization of the ideal characters,thus permeating the ethical teaching function of literature and the ideal pursuit of justice in the writings on the unfair trials.
