双重不对称合作:平台内容治理主体责任的运行与优化

摘　　要：将主体责任这一中国特色法治话语运用于平台内容治理是一种创新的治理方式,具有新型复合特征。从政府与平台合作互动的角度出发,平台内容治理主体责任的运行具有权力责任、成本收益双重不对称的特征。但不对称并不代表不平衡或不合作,通过“不对称杠杆的平衡”模型将权力责任与成本收益的调节相对接,能促进政府与平台间的非对称性互惠与合作。在完善主体责任时,可以明晰平台治理权力的公法责任约束,以平台尽职免责为激励机制,释放政府与平台基于公共利益互惠行动的活力。适用“因人而异”的不对称规制,以嵌入式合作为抓手,根据支付能力和管控能力对平台分级分类并形成平台内容治理主体责任的指南清单。Applying the Chinese characteristic legal discourse of subject responsibility to platform content governance is an innovative governance approach with new composite characteristics.From the perspective of cooperation and interaction between the government and platforms,the operation of the main responsibility of platform content governance has the characteristics of double asymmetry of power-responsibility and costbenefit.But asymmetry doesn't mean unbalance or uncooperative.The adjustment of power-responsibility and cost-benefit through the"asymmetric leverage balance"model can promote the asymmetric reciprocity and cooperation between the government and the platform.When improving the main responsibility,it is possible to clarify the public law responsibility constraints of platform governance power,and use the platform due diligence exemption as an incentive mechanism to release the vitality of mutual action between the government and the platform based on public interests.Applying asymmetric regulation that varies from person to person,is to use embedded collaboration as a tool,classify platforms according to their payment and control capabilities,and form a guide list of responsibilities for the main responsibility of platform content governance.
