摘 要:数字商业模式催生的“零工经济”就业人员面临着职业伤害风险大、缺乏有效制度保障的困境。因“零工经济”群体同平台间的关系难以被认定为传统劳动关系,加之社保系统不健全、立法滞后、新型运营模式的冲击等因素的影响,该群体往往难以有效纳入现行的工伤保障机制中。通过总结各地试点经验发现,唯有平衡分配政府、平台、就业者三方权利义务,推进保险制度与劳动关系适度脱钩,优化缴费模式,明晰工伤认定规则,探索建立职业伤害保障新机制,才能实现互联网零工经济的健康发展。The employees of the gig economy spawned by the digital business model are facing the dilemma of high risk of occupational injury and lack of effective system protection.Because the relationship between the gig economy group and the platform is difficult to be identified as traditional labor relations,and the influence of the imperfect social security system,the lag of legislation,the impact of new operation modes and other factors.The group is often difficult to be included in the current industrial injury protection mechanism.Summing up the pilot experiences in various regions,only by balancing the rights and obligations of the government,the platform and the employees,making the insurance system and labor relations moderately decoupled,optimizing the payment mode,clarifying the identification rules of industrial injury,and exploring the establishment of a new mechanism for occupational injury protection,can the healthy development of the Internet gig economy be realized.
