摘　　要：中国式现代化是中国特色与现代化普遍特征的有机统一。法治是中国式现代化的重要依托,法学理论创新是中国式现代化的动力源泉。伴随现代化进程加快,法律调整对象呈现领域化态势,社会问题愈发错综复杂和综合多变,传统部门法学知识体系难以全面、有效地予以应对。领域法学既是法学研究新范式,也是国家治理新思维,具有问题导向性、整合协同性、开放包容性等典型特征,与部门法学构成互补关系。从功能上看,领域法学有助于构建中国特色法律规范体系、法学学科体系、学术体系与话语体系,促进国家治理思维和方式转变,为法治实践提供科学的理论指引。领域法学对中国式现代化进程的影响是全方位、深层次的,应从加强重点领域和新兴领域立法、推进服务型政府建设、深化司法专业化改革、创新法学教育模式、丰富法学研究方法等多维度实现其功能担当。Chinese modernization is the organic unity of Chinese characteristics and the universal characteris⁃tics of modernization.The rule of law is an important support for Chinese modernization,and the innova⁃tion of legal theory is the driving force of Chinese modernization.With the acceleration of the moderniza⁃tion process,the object of law adjustment is becoming more and more territorial,and social problems are becoming more and more complex and comprehensive,which makes it difficult for the traditional legal knowledge system of the department to respond comprehensively and effectively.Domain jurisprudence is not only a new paradigm of legal research,but also a new way of thinking of national governance.It has typ⁃ical characteristics such as problem-oriented,integrated and collaborative,open and inclusive,and is complementary to departmental jurisprudence.From the functional point of view,domain law is conducive to the construction of legal norm system,legal discipline system,academic system and discourse system with Chinese characteristics,promoting the transformation of the way of thinking and mode of national gov⁃ernance,and providing scientific theoretical guidance for the practice of the rule of law.The influence of domain law on the process of Chinese-style modernization is all-round and deep,and it should fulfill its function in several aspects,such as strengthening legislation in key areas and emerging areas,promoting the construction of service-oriented government,deepening the reform of judicial specialization,innovat⁃ing legal education mode,and enriching legal research methods.
