行为对象三元划分下的财产性利益个别研究——以盗窃罪为例

摘　　要：对财产性利益是否属于财产罪的行为对象这一问题的研究存在概念混淆和理论误解。将行为对象划分为用语行为对象、要件行为对象、实际行为对象,有助于在提升刑法解释的灵活性的同时捍卫罪刑法定原则。对财产性利益进行“单个引入、单个分析”,能够避免过去“先定义引入、后统一分析”的研究范式的弊病。盗窃罪用语行为对象的标准是:具有管理可能性,具有价值性,被合法所有或享有;管理可能性包括事务管理可能性和物理管理可能性。盗窃罪要件行为对象的标准是:属于盗窃罪用语行为对象,具有占有可能,具有占有事实。占有可能包括事实占有和规范占有,占有事实包括行为人的占有和被害人的占有。盗窃罪的秘密要件和违背被害人意愿要件一般不会对盗窃罪要件行为对象的框定产生影响。There is conceptual confusion and theoretical misunderstanding in the study of whether interest of property belong to the acting object of property crimes.Dividing acting object into linguistic acting object,element acting object,and actual acting object helps to defend the principle of legality of crime and punishment while enhancing the flexibility of criminal law interpretation.Conducting individual introduction and analysis of property interests can avoid the drawbacks of the previous research paradigm of introducing by defining and unified analysis.The criteria for the linguistic acting object of theft are:having the possibility of being managed,having value,and being legally owned or enjoyed.The possibility of being managed includes the possibility of being transactionally managed and the possibility of being physically managed.The criteria for the element acting object of theft are:belonging to the linguistic acting object of theft,possessing the possibility of possession,and possessing the fact of possession.Possibility of possession includes factual possession and normative possession.Fact of possession includes the possession of the perpetrator and the possession of the victim.The element of secret and the element of violation of the victim's will of the crime of theft generally do not affect the framing of the element acting object of the theft.
