摘 要:环境污染第三方治理模式是推动环境污染治理市场化、专业化、产业化的重要途径。然而,由于现有规则无法为各方主体行政责任的界定提供充分依据,在第三方治理中存在着第三方承担行政责任的情形不明确、行政处罚种类的适用及依据标准模糊、行政优益权的行使缺乏行政处分的有效规制等问题。因此,有必要在区分第三方治理模式类型的基础上,明确第三方承担行政责任的情形,并以合同履行程度为重点,引入企业环境信用评价,确定行政处罚的具体方式,加强对环境行政协议的规范约束,促进第三方治理模式在运行中的有效性。The third party governance model for environmental pollution is an important way to promote the marketization,specialization,and industrialization of environmental pollution governance.However,because the existing rules cannot provide sufficient basis for the definition of the administrative responsibility of the parties,there have been issues in the third party governance,such as unclear situations of the third party assuming administrative responsibility,the vague application and standards of the types of administrative punishment and the lack of effective regulations on the exercise of administrative prior rights.Therefore,on the basis of distinguishing the types of third-party governance models,it is necessary to clarify the situations in which the third party assumes administrative responsibility,and to determine the specific ways of administrative penalties by focusing on the degree of contract performance and introducing enterprise environmental credit evaluation,and strengthen the normative restrictions on environmental administrative agreements to promote the effectiveness of the third-party governance models in operation.
