摘 要:为顺利加入CPTPP,越南对其《劳动法》及工会制度进行了改革,使之符合CPTPP关于劳工制度的标准和要求。其改革举措主要体现为建立多元化的基层劳工代表组织与完善集体谈判制度。中国的劳动法及工会制度在工会组织结构、批准设立等方面与越南具有相似性。因此,在CPTPP背景下,如何借鉴越南改革的经验教训,坚持在党的领导下完善符合中国国情的劳动及工会法律制度是我国劳动领域亟须解决的一个重要问题。In order to smoothly join the CPTPP,Vietnam has reformed its Labor Law and trade union system to comply with the standards and requirements of the CPTPP regarding the labor system.Its reform measures mainly include establishing diversified grassroots labor representative organizations and improving the collective bargaining system.China’s labor law and trade union system share similarities with Vietnam in terms of trade union organizational structure and approval of establishment.Therefore,in the context of the CPTPP,how to learn from the experience and lessons of Vietnam’s reform,and adhere to the leadership of the Party to improve the labor and trade union legal system that is in line with China’s national conditions,is an important issue that urgently needs to be addressed in China’s labor field.
