论IPTV回看的法律定性

摘　　要：在对当前IPTV回看行为的法律定性进行分析的基础上,指出对于IPTV回看的考量与定性,应考量回看和直播的关系、回看的技术特点、回看与信息网络传播权的交互式传播间的区别、产业政策和公共利益。对于IPTV回看的法律性质,目前理论和实务上主要有两种观点,即属于广播权范畴或者属于信息网络传播权范畴,IPTV回看应该属于广播组织权范畴。The legal nature of IPTV review is analyzed.The result shows that the nature of IPTV review is determined by the relationship between review and live broadcasting,the technical characteristics of review,the differences between IPTV review and interactive communication of information network communication rights,the industrial policies,and the public interest.The legal nature of IPTV review belongs to the domain of broadcasting rights or information network communication rights.IPTV review belongs to the domain of broadcasting organization rights.
