一致性规则的域外演进与中国路径——以黄河流域环境保护法律的体系完善为视角

摘　　要：黄河流域的保护需要系统性和整体性的法律制度支撑。借鉴域外一致性规则在内河流域管理中的成功经验,对于我国黄河流域的环境保护具有重要的启示意义。一致性规则相对于传统的行政管理体制,具有独立性和扩展性,有助于实现国家环境保护目标,并契合我国法律体系的精神。为推动黄河流域的可持续发展和生态保护,我国应在多个层面引入一致性规则。首先,应统一和优化环境保护标准,确保不同区域和部门的政策协调一致。其次,应设立跨部门的环境影响评估专家委员会,以实现环境影响评估的综合化和科学化。最后,应进一步强化法律的实施与监督机制,确保相关法律法规得到有效执行。通过这些措施,我国可以在黄河流域的保护与管理中实现更高水平的法律保障。The protection of the Yellow River basin requires the support of a systematic and integrated legal system.To learn from the successful experience of foreign consistency rules in the management of inland river basins is highly significant for the environmental protection of the Yellow River basin in China.Compared with the traditional administrative system,the consistency rule is independent and expandable,which helps to realize the national environmental protection goal and conforms to the spirit of our legal system.In order to promote the sustainable development and ecological protection of the Yellow River Basin,China should introduce consistency rules at multiple levels.First,environmental protection standards should be unified and optimized to ensure that policies in different regions and sectors are coordinated.Secondly,an inter-departmental expert committee on environmental impact assessment should be set up to achieve comprehensive and scientific environmental impact assessment.Finally,the implementation and supervision mechanism of laws should be further strengthened to ensure the effective implementation of relevant laws and regulations.Through these measures,China can achieve a higher level of legal guarantee in the protection and management of the Yellow River basin.
