民法典视域下买卖型担保的法律适用研究

摘　　要：《民法典》是我国民事法律领域的基本法,对各类民事法律关系进行了全面规范,为买卖型担保的法律适用提供了重要的法律依据。然而,《民法典》及相关司法解释对于买卖型担保的具体规定尚不够完善,在实践中对于买卖型担保的性质认定、效力判断及法律适用等方面存在诸多分歧。深入研究民法典视域下买卖型担保的法律适用问题,不仅有助于明确买卖型担保的法律地位和效力范围,而且有助于为司法实践提供统一、明确的法律指引。基于此,从民法典角度出发,对买卖型担保的概念、特征及其在实践中的应用情况进行概述,详细分析买卖型担保的性质、效力认定,并且针对买卖型担保在法律适用中的不足提出相应的完善建议,旨在充分发挥买卖型担保的担保功能,促进我国非典型担保制度的进一步完善。The Civil Code serves as the fundamental law in China's civil legal domain,comprehensively regulating various civil legal relationships and providing an important legal basis for the application of sale guarantee.However,the Civil Code and its related judicial interpretations offer incomplete provisions regarding sale guarantee.In practice,there are significant disagreements concerning the identification of its nature,the determination of its effectiveness,and its legal application.In-depth research into the legal application of sale guarantee from the perspective of the Civil Code not only helps clarify its legal status and scope of effectiveness but also provides unified and clear legal guidance for judicial practice.This paper provides an overview of the concept,characteristics,and practical application of sale guarantee,analyzes its nature and validity from the perspective of the Civil Code,and proposes suggestions for improving the legal application of sale guarantee to fully realize its function as collateral and promote the further development of atypical security systems in China.
