我国集体土地征收的司法审查及其优化

摘　　要：通过对1 172份高级人民法院有关江苏、陕西以及河南三省集体土地征收案件的实证分析,发现我国集体土地征收的司法审查中,法院出于职能定位及信息、专业和权力等因素的考虑,表现出显著的程序偏好。这种程序偏好反映出我国集体土地征收中存在的法院能动性受限、征收程序有待完善以及诉讼机制与立法目的之间错位等问题。因此,应增强集体土地征收司法审查中法院的能动性,完善我国集体土地征收的程序自治功能建构,促进我国集体土地征收司法审查实质性与程序性基准的结合以及推动我国集体土地征收司法审查判断要素的拓展等,以期协调集体土地征收所涉及的复杂利益关系,从而更好地推动乡村振兴与农业农村现代化。Through an empirical analysis of 1172 cases of collective land expropriation by the Higher People's Courts in Jiangsu,Shaanxi and Henan provinces,this article finds that in the judicial review of collective land ex-propriation in China,the courts showed a significant procedural preference due to factors such as functional positio-ning and information,professional and power considerations.This procedural preference reflects the problems that exist in collective land expropriation in China,such as limited court initiative,expropriation procedures that need to be improved and non-bridging nature of the litigation mechanism and the legislative implication.Therefore,it is pro-posed to enhance the initiative of courts,improve the construction of procedural autonomy functions,promote the combination of substantive and procedural benchmarks,and promote the expansion of judgment factors for judicial review of collective land expropriation in China,so as to coordinate the complex interest relationships involved in collective land expropriation,and to comprehensively push forward rural vitalization and accelerate the moderniza-tion of agriculture and rural areas.
