摘　　要：在劳动经济学中,“买方垄断”是指在劳动力资源市场化配置中,买方利用其市场力量,对劳动者薪资水平或劳动条件施加限制的能力。为解决该问题,近年来,一些国家和地区开始在劳动力市场引入反垄断监管,但在理论界,关于反垄断法是否应该介入劳动力市场仍然存在分歧。劳动法聚焦于“劳-雇”关系的调整方式使其在规制买方垄断时,具有功能局限。劳动力要素的市场化变革以及反垄断法的内在机理,使其介入劳动力市场具备实践和法理基础,但应该以行为具有竞争损害为介入的基本遵循,并以间接实现对劳动者权益的保护为其正当性基础。在具体路径上,应革新相关市场的认定思路,针对性地调适反垄断法“三大制度”,并实现与劳动法规制的协调配合。In labor economics,“monopsony”refers to the ability of buyers to use their market pow-er to impose restrictions on workers'wages or working conditions in the market-oriented allocation of la-bor resources.In order to solve this problem,in recent years,some countries and regions have begun to introduce anti-monopoly enforcement in the labor market,but in the theoretical community,there are still differences on whether anti-monopoly law should intervene in the labor market.The labor law focu-ses on the adjustment of the“labor-employment”relationship,which makes it has functional limitations in regulating the monopsony when regulating the buyers'monopoly.The historical interweaving of the anti-monopoly law and the labor market,the market-oriented reform of labor factors,and the internal mechanism of the anti-monopoly law provide a historical,practical and legal basis for its intervention in the labor market.However,the basic principle of intervention should be based on the competitive dam-age caused by the behavior,and its legitimacy should be based on indirectly protecting the rights and in-terests of workers.As far as the specific path of the Anti-Monopoly Law to intervene in the monopsony in the labor market,it is necessary to innovate the way of identifying the relevant market,adjust the“three major systems”of the Anti-Monopoly Law in a targeted manner,and achieve coordination and cooperation with the labor laws and regulations.
