行政法视域下我国开发区法定机构主体地位研究

摘　　要：我国法定机构改革实践探索多集中于各类型的开发区,其在实践中面临诉讼赔偿的责任诉求与治理能力提升的迫切要求,需要对开发区法定机构的主体定位予以辨析明确。在救济法视角下,可基于“授权—委托”行政说与“诉讼—责任”话语体系获得行政职权或代为行使行政职权进而拥有诉讼与赔偿资格。在治理法视角下,基于“公共行政”说可以成为社会行政主体,基于开发区法定机构的职权职责可以成为行政法人。综合行政法法理与我国开发区法定机构改革的实际,法定机构在立法机制方面建议采用统一立法与分别立法相结合的立法模式,通过更高的立法位阶进行立法。China's statutory bodies reform practice exploration focuses on various types of development zones,which in practice is faced with the responsibility of litigation and compensation claims and the urgent requirements of governance capacity enhancement,and needs to identify and clarify the positioning of the main bodies of the development zone statutory bodies.In the perspective of remedy law,based on the administrative theory of"authorization-entrustment"and the discourse system of'litigation-responsibility",it is possible to obtain the administrative power or exercise the administrative power on behalf of the development zone to have the qualification of litigation and compensation.In the perspective of governance law,based on the"public administration"theory,it can become a social administrative subject,and based on the powers and duties of the statutory bodies of the development zone,it can become an administrative legal person.Based on the comprehensive legal principles of administrative law and the actual reform of statutory institutions in China's development zones,it is recommended that statutory institutions adopt a legislative model that combines unified legislation with separate legislation in terms of legislative mechanisms,and legislates at a higher legislative level.
